Parent asks ... "Can they [Novell] appeal again?"

I would certainly expect Novell to be able to.

It is not like Novell does not have enough ammo.

It sure would be nice if there were some more effective
cluebat that higher courts could use against less cluefull
lower courts when and where appropriate. It seems that
perhaps this particular judge in this particular case
might stand to get a nice big dose of correction.

Of course, until the judge gives a final ruling,
it is too soon to draw too strong a conclusion,
but there are plenty of signs to make one wonder.

What else can Novell do?

I certainly hope so.

They would only have to overturn this Rule 50 motion (which shouldn't be hard, based on this report) and ask for a new judge as a consequence. That would get them a new jury trial under considerably more favourable circumstances.
