The software companies are unlikely to do this. I'd like to
think that Google *just might*, as the "nuclear deterrent"
against future patent attacks on Android.

However, OfficeMax and Staples probably don't have a
software patent portfolio to protect, and they must be
seriously ticked off about having this ridiculous
distraction to their non-software business. IM(NL)O they
should throw in a "software is math" defence for
completeness.

Who knows, maybe Interval would back off if they thought
there was even a 1% chance of that particular bomb going off
under them.

I would sure like to see them take this argument out for a spin. Up to now we
have all just been spinning our wheels while every one ignored the elephant in
the room.

A bit tongue-in-cheek

But how's about a more elaborate “it is all mathematics insanity plea”?

If a company could write it into the employment contracts that accidental patent
infringement in product design was the liability of the employee. Then the
employee could surely argue insanity on being unable to distinguish software
patents from academic institution taught mathematics.

Something that would then require psychologists to test the argument “all
software patents are mathematics”.
