I don't believe that anyone (including Ellison and his lawyers) thinks that this
motion is going to beat Google.
As Oracle admits (and PJ has pointed out) this is part of the legal rigmarole.
Oracle has to put all of this junk into this motion in case a higher court rules
-- in Oracle's favor -- that there was some error. Oracle wants to include
every aspect as to which it claims there has been an error. That way, if a
higher court does hold that there has been an error, Oracle can have its way as
to that specific aspect.
This is the way the legal dance plays out. Oracle has to tell Judge Alsup now
exactly what he has done wrong, in order to get relief from the higher court.
If Oracle fails to do so, the higher court will say (I paraphrase, of course),
"Tough luck, you waived that issue. You didn't complain about this to
Judge Alsup in June, so don't complain to us now."[ Reply to This | Parent | # ]
