I could be wrong...but...
with patents...the offical statement appears to be that
funded institutions may apply for IP, but must commit to
delivering technology to poor people at an affordable cost
as a condition of funding. This is reasonable for someone
who believes in capitalism. (Assuming it is worth
buying...people are still better off.)

...for donations...while there is some investment
opportunity in giving M$ software to an impoverished child,
the ROI is likely to be really, really small. Within his
lifetime, those children will probably have yearly incomes
of 1k USD, of which almost everything will be spent on food.
Gates can find better places to invest to make money.

In regards to outside institutions owning IP/technology that
is used to deliver goods to poor countries and thereby
having power over them - that's a real problem - but tricky
to resolve in a cost-effective fashion.

In terms of this gigantic sum of money distorting public
health policy towards Gates's views...well...that's
happening, but...it wouldn't happen if any first world
nations were willing to spend tax dollars towards helping
the third world. (The foundation is a few billion
yearly...that's a couple of bombers here. The US could
afford a few 100B yearly if we stopped wasting money
elsewhere.)

Look into vaccinations. There you will find darker secrets that blow the minor
concerns you have raised right out of the water.
