You cannot always do what you want on land you own. For
instance, you cannot build a grocery store in a residential
area; or a parking lot in downtown Manhattan. For that you
need zoning approval.

The island might have zoning regulated by the govt of Hawaii,
or the residents which, presumably live mostly in the 2%
that is not for sale. Ellison or the corporation has at
most one vote, vs the 3600 that live on the island.

Then there could be environmental regulations from any
number of agencies.

While it is possible for Ellison to do certain things,
he will have to go thru the proper hoops and sell his
proposals to agencies, the government and the voters.

My guess is that Ellison is not going to do anything
drastic. We see him here on Groklaw as the evil ogre,
perhaps on par with Gates, Balmer of Florian. That may
well be, but he also loves sailing, the sea, and
presumably the beauty of sailing in unspoiled coves and
bays. He may build a marina with a very modest footprint,
but I doubt if he is going to build a Miami Beach over
there. That is my guess, but a sort of educated one.

Because you can't buy an island overnight, I suspect the purchase was in the
works in anticipation of damages being greater than $0.
