It's management and inside council that has to make those decisions. You can always find trial lawyers who will be eager to do it for cash. You can blame the tactics on BSF, but not the overall strategy so much. Gosling< /a> (language warning):
Oracle finally filed a patent lawsuit against Google. Not a big surprise. During the integration meetings between Sun and Oracle where we were being grilled about the patent situation between Sun and Google, we could see the Oracle lawyer's eyes sparkle.
BSF wouldn't have been there.

True... but at the same time...

BSF would have been there putting in their two cents as the initial plans fell apart. If BSF wasn't there, such as with that oops where BSF filed an apology with the Court, would the case have continued or been settled long before trial?

Was it BSF who pitched the idea Oracle should file for "infringer's profits" rather then target statutory damages with the little copyright infringement that was found? Did they manage to convince Oracle management that was a good idea? Was management finally paying attention to reason when Judge Alsup told Boiese it was a ridiculous position?

Interesting questions! And we have no current way of knowing what really happened.
