If the article had actually talked to Novell for comment(or was even passingly familiar with the SCO litigation), that is what they would have found out. So either they're incompetent and did no research, or they no and deliberately worded the statement to be arguably true but false as written.
The guy that wrote the SLTrib story was also the guy that covered the SCOGvNovell trial for the Trib. Some of us met him in the courthouse. I talked with him for a while. He seemed to be SCOG-oriented at the time. You can check the observer reports in the Groklaw archives, if you wish...

I'll leave it to you to make such conclusions as seem warranted.
