The paper, words are written on, is tangible.
The meaning of those words is intangible.

The paper, software is written on, is tangible.
The functional intend for this software is intangible.

The hardware registers the software is being loaded to (to perform operations)

Software is tangible
Authored by: Ian Al on Tuesday, June 12 2012 @ 05:00 AM EDT
Computer operations do make physical changes like making a lcd glow or start an engine so software has to be tangible. Software is not math.
LCD screens put patterns on the screen and illuminate them so they glow. Ignition keys start engines.

If you use the data in a computer memory to control an electro-mechanical device then it can appear that the computer makes the device operate. It doesn't. Human beings design computer interfaces to take abstract values from the computer and use them for external purposes.

If you look at my comment 'Warning: may contain elderly auto analogy' I cover such things with my gearbox example, and discuss what is and what is not patentable under the law.

Software Patents: It's the disclosed functions in the patent, stupid!
