I don't think they can be.
As I've been arguing in other parts of this thread: There is a good argument to
be made that patents do not bring the benefits they are perceived to be
bringing. The cost of patents is easily enumerated in terms of lawsuits, trolls,
and lost business. But the benefit? Even in the 1790's there was none. Why would
there be now?
And yes, there's the tired old example of the pharmaceutical industry. Which is
an industry that can be best described as being addicted to their monopoly
profits. It isn't actually good for them. Nor is it good for us.
(My major inspiration here is a book called "Against Intellectual
Monopoly". I won't be linking to it again, but with a bit of searching you
