It has always been my understanding that if you want private justice between the
two parties you should go to arbitration, if you go to court the general policy
should be everything is public unless making it public is against the interests
of justice and good governance, and where such a situation occurs the minimum
amount of secrecy compatible with the overarching aim should be employed.
If this is the case the courts must stop thinking that they are free to act as
they see fit but must consider the public at the same time as themselves and the
parties to the case, if it is not the case civil case judges and other court
costs should stop being paid out of public funds!
