Actually, one of the current worries of the Chinese patent office is that too
many patents are issuing of dubious worth.
It's not that China isn't signed up to IP treaties. It has been a member of the
WTO since December 11 2001, hence TRIPS and even the PCT. Many of it's better
patents are pirated by foreign firms with Chinese partners. One notorious case
involved pollution scrubber equipment, for example.
Currently China's disputes filed against other countries are outnumbered 26 to 9
by others against China, but that won't last. China's increasing economic power
means it's in her interest to enforce patent and copyright rules. It is
therefore flexing its muscle.
For example a couple of weeks ago it filed a WTO complaint against the US
regarding countervailing duties. There is a real prospect of a WTO ruling
against the US, which would mean compensation is payable, and if the US refuses,
the aggrieved party (China) can be granted the power to ignore US intellectual
property up to the value of the dispute.
