Thank you for this. Your points are well worth thinking about. I have two
immediate reactions to your post.
First, I have a minor problem with your term "state sponsored", which
sounds like the government came first, then realized the value of the property
concept, and imposed it upon the people. I believe each concept of property
arose with the people, who then required the codification of their common
practices into law.
I think the term "state sanctioned" would more accurately depict the
role of the community in enforcing property concepts. I wish I could have said
this more concisely.
Second, I note that your fourth bullet point exactly describes the case of Sun
allowing a thriving community to flourish in the fertile ground of Java, and
Oracle subsequently acquiring the right to harass and assault that community.
Truly it is said that there is nothing new under the sun.
