I completely agree with your observation that this order has been tightly
worded and agree that one possible value of this is to make it difficult for
the Court's intent to be misconstrued.
Judge Alsup knew in advance that this decision would be appealed and it's
transparently clear that not only has he done all he can to ensure that the
right verdict was returned, but that the verdict will be able to withstand
appeal.
There were many times in this case where I wondered if Judge Alsup was
being unduly harsh towards Google, but with the luxury of time to go back
and read transcripts it's clear that he was in fact living up to his own self-
defined standards of getting the counsel to advance their best arguments.
With no disrespect or slight intended to any other Judge that we've followed
here at Groklaw, I think this one is the most effective. [ Reply to This | Parent | # ]
