The issue of damages is still outstanding and I'm sure Oracle would like to
appeal that number at the same time as the rest of it.
Also maybe I misunderstood something (that is highly probable) but I understood
Google's fair use arguments also applied to the 9 lines and the 12 test files.
That still seems to be hanging out there. It also seems that de minimus aptly
describes 9 highly functional lines that perform a standard software check
representing 0.3% of the file they were in and while there may be a number of
ways to do that, it doesn't seem like there would be than many efficient ways.
Of course the Judge still needs to enter a final judgment.
