Though you may not be of a vintage to recall when people
commonly xeroxed a few copies of a document.

Clorox
Authored by: Anonymous on Saturday, May 26 2012 @ 02:54 PM EDT
Bleach is commonly known as Clorox here in TX. In Canada the locals were
calling bleach by another local brand name -- I was confused because the brand
name didn't match any products in their wash room, and they were a little
surprised when I couldn't complete the simple task of fetching the bottle of
"Javex".

Many southerners call all carbonated canned beverages "Coke" -- When I
moved here from a more northern latitude as a child it was confusing. them:
"Hey, what kind of Coke do you want?" pointing to an ice chest.
me:"Uhm I don't want any... but Is there any orange Pop?" them:
"Either you want a Coke or you don't which is it?"

If someone were being sued for use of brand names in common conversation on the
Internet, then the mark holder should lose the mark's protection over this
because they failed to protect it from all the spoken language uses...

Additionally, I think copyrighted works should also loose protection if they
become firmly entrenched in culture. This was the concept behind the LIMITED
monopoly we grant such right holders -- To return things to the public domain.

Warner Bro.s claims to own copyright on the "Happy Birthday" song. I
would argue that when your cultural contribution becomes a solid fixture such
that the majority of citizens infringe your work via public performances:
Congratulations, mission accomplished, by definition, it part of the PUBLIC
DOMAIN now.
