MS in the day, was growing, embracing, extending,
extinguishing, in government supported viral ways, without
penalty. And directly in the MS sights, was the enterprise
UNIX installs. So, many of those were SUN's existing
customers and lines of UNIX business areas, that without
those, who then is SUN? Everyone was thinking" "how do we
slow Microsoft down"... and key is applications?
Any shot into the sides of the unsinkable MS war ship, would
have the affect of slowing them down a little bit (as anti-
trust case, had no affect at all). So, SUN CEO was smart
and freed JAVA (as that has helped, even to this day, to
slow Microsoft in the Android vs MS phone situation that was
the reason why Google did Android in the first place).
Oracle should be thankful that JAVA was freed, and to
support FREE software more than they do (look at what they
are doing to MySQL to see that they are trying to take that
proprietary these days, over the long term, as a plan, as
well).
Hmmm, I wonder how much MS stock that Larry owns? Does he
favor MS in any way? Any conflict of interest that his
stockholders should be aware of?

The crux of the problem is that Java ME didn't do what Google needed and Sun
would not license J2SE for that use.
I'm surprised that this message was not delivered more forcefully to the jury.
I'm also surprised more wasn't made of Google having a license for Harmony.
But I could have missed that. It seems to me both sides spent too much time on
the actions of executives and too little time of the actual stuff.

Just a quick note that you might want to check your stated
"FACT"...Linux's
initial release was in 1991, only a few months after the
release of Windows
3.0. Windows 3.0, while successful, was hardly
the biggest OS player, let
alone a monoply of reckoning.
The reality is, most of the development
of Linux and
its GNU tools was during the days of Mac, Amiga, and DOS when the
big players (IBM, HP, ATT et al) all cared about Unix mainframes and
terminals
rather than standalone workstations. OSS software exists
because of Unix.
Hmm...perhaps that explains why it it GNU (GNUs Not Unix) and not
GNMS
and it is
Linux instead of Lincrosoft.
Even today, while very
much considered an alternative (if not primary)
option over Unix in many cases,
is not a very serious desktop contender
to MS. It is the adoption of tablet and
a return to a mainframe style of
computing
(Cloud Computing...centralized
computing with dumb(ish) workstations
connected to it...this is the entire
premiss of Chrome OS and VM thin/
zero clients) that are the real threat to
MS
on the workstation. Some of these assults very well may be Linux
based, but
the
idea of them being any form of theat is fairly recent.
Sun's
business decisions had little to do with MS directly and
were done much more
due to a changing market in which they were
struggling. Intel and AMD began to
commoditize the lower end sever
market allowing Unix (x86), Linux, and MS to
began cutting into both
their hardware and software market. Failing primary
business,
issues monetizing Java, a large amount of angst with the development
community (affecting the ability to attract new developers and stop the
bleeding of current ones), and a lack of direction is what led them to the
hail mary pass of OSSing Java more than anything.
