If you don't care about flushing 40 million down the toilet why would the threat of losing 80 million deter you?

The point of loser pays is that people that are well funded start demanding the other side pony up serious money in case they lose, and it is obvious that they non-rich person can't do that, so you get an order dismissing the matter because they can't afford to pay if they lose.

Loser pays sounds good, sort of like citizens united, until you realize that one side can put tens of millions at risk without issue and the other side will be bankrupt if they lose 100k. A 90% chance of winning when the cost of losing is everything you own is more or less denying justice to the middle class.

The US has a huge wealth and income gap that is close to as great as that of sub Saharan countries.
