In addition, it may be an ABI, but at some point you have to describe that ABI,
document it and make it available in the same way as the API in Java, so I would
have thought the judge has good grounds for saying there may be substantial
similarity in the cases.

Yes, there is an interface, but because you are only passing the BIOS raw numbers, you can define that interface in an infinite number of ways. For instance, there is no need to use the IBM/M$ terminology at all.

You could even write a substitute BIOS programmers manual with all the function names completely different, or written in French or German, or do it the hard way, from the days before assemblers were invented, by programming it all directly in machine code.

You don't need to stick to someone else's notion of the textual description of the BIOS calls, so you can do it all in umcopyrightable numbers.
