This is hard for the jury to understand no doubt, especially given how Oracle's
expert worked so hard to mislead them, but Google optimized the static array
initialization by doing a glorified search & replace on the bytecode. This
is peephole optimization and it is very old.
They did not have anything pretending to be a VM executing the instructions and
Google's expert conclusively proved that, if the jury knows to believe him. But
the really confusing part is that they do have something that can do simulation,
they just don't use it there as the patent requires.
I feel sorry for the poor non-technical jury trying to figure out what the heck
all this is about. This is clear-cut to a competent programmer who knows how
this stuff works. But it's confusing as heck for anyone who has no clue what
half of the words mean, especially when the judge isn't legally permitted to
answer about half of their questions.[ Reply to This | Parent | # ]
