While the reasonable thing to do is to settle, some part of me believes that
Oracle is simply not reasonable enough to go along with that entirely reasonable
plan.
I think they have visions of $billions dancing around in their heads and they'll
be upset whenever reality starts to intrude.
They're known for their sharp business practices after all. Do you know the
joke about the difference between a mugger and an Oracle sales rep?

While Google has learned a lot of what Oracle is claiming etc what is to stop
them jumping back to some of their original positions again after Google gives
evidence to disprove there current position? Then we would be back in the same
confusion all over again!

Given what we have seen Oracle doing to SAP in the courts, I don't think they
would settle unless they are pressured to change the way they work due to some
