About simulated execution on a stack machine being impossible without
manipulating the stack - and since the stack was not manipulated, it proved that

their code wasn't using simulated execution.

I think (and I may be wrong) that the stack based nature of Dalvik (as opposed
to
JVM) might be fueling these "misunderstandings" and arguments.
Possibly they
have different upshots when considering Dalvik vs considering JVM.

I'm not a VM guy (or lawyer) though, so take with a pinch of salt.
