The questions these jury has been asking reveal they failed to grasp important
technical concepts. Not to mention the simple instructions.

I'm extremely frustrated with the way this 2nd phase of the trial has
unfolded. But if Judge Alsup is too, maybe something good might still
come of it. I hope somehow he will be able to deliver justice in this
twisted case. Invalidate these garbage patents, give Oracle $1.09 for the
rangeCheck and PolicyNodeImpl code, and award attorney's fees to

I just thought I would throw that out there from the criminal side. Obvious
reasonable doubt from the jury on infringement, so they should side with Google.
If it were clear and obvious, we would have had a verdict on the first day.

By the time the jury returns a verdict, one of the patents will probably be

You certainly have to wonder whether this motion was
not prompted, at least in part, by a desire by Google to get the reexamination
of the '104 patent to a final action, but that's just speculation. What is clear
is that Mr. Van Nest is going to disappoint his family by having to cancel their
scheduled May vacation overseas.
If the trial had been delayed
until re-examination was complete the trial may have been much simpler and Mr.

The judge is frustrated, but he's clearly a very smart man. While I don't like
the details of this specific portion of the trial, I still admit to having a
certain amount of faith in his ability to come up with something sane in the
end.
