Have a look at the definition of waiver by conduct ; that page also has a useful link to the definition of estoppel, which quotes a nineteenth century judge:

"A man shall not be allowed to blow hot and cold - to affirm at one time and deny at another - making a claim on those to whom he has deluded to their disadvantage, and founding that claim on the very matters of the delusion."

That seems to fit the current situation quite nicely, and explains why Sun/Oracle may not now do something which on the face of it they have a right to do.
