And if you CAN'T design around it, surely that promptly kills the patent as
being a "patent on an idea"? Seeing as the whole point of patents
seems to be to encourage multiple attacks on a problem.

... and it wouldn't redesign without its lawyers advice ...

I know your comment is narrow, however, it scares me that now a software engineer has to consult a lawyer for design advice, ever. If the lawyer had a degree in computer science, maybe I'd feel OK but this seems like a really bad situation. i.e. Leaving design decisions to those not qualified to make them.
