I do so enjoy a train wreck (Fresenius v Baxter, PTO overrides Federal Circuit)

>"Infringers and competitors can get multiple attempts to invalidate
patents? If they lose in one venue, they can simply re-file the case in another
venue? What a waste of judicial and PTO resources."

>But it's a waste Americans have (indirectly) voted for. This situation has
the express approval of the legislative branch (because that's what the
lobbyists want).

This "waste" as you all call it, is just simply the rule of law. I, as
a creator and user of technical devices that are obvious to ME, cannot be bound
by a patent troll and his surreptitious accomplice--who fake a lawsuit in which
the accomplice stupidly challenges the validity of a patent in order to lose.

I have a right to my own determination, based on my own knowledge of the
appropriate art and my own research on the generally known elements. And yes,
all judicial activity is "wasteful"--after all, it's so much faster
and cheaper just to hang anyone accused of criminal activity!
