If there is just one hold-out in each phase, my conspiracy detector will go off
the scale.
Mind you, it is a Winphone 7.5 app and probably not something you want to take
too seriously.

yep.. Oracle weeded out anyone that knew anything about programming... or
computers.. bet they wish they could weed out the judge due to his terribly
inconvenient knowledge of programming. It's really hard to bamboozle someone
when they know more about the subject matter than you do.
As for the jury.. I think the hold out actually helped Google in the copyright
phase.. Keep in mind that back the jury didn't know the blog was official for
sun and a few other things that have become known... I suspect the hold out was
the one stopping them deciding fair use wasn't a valid excuse in this instance.
But we won't really know that until it's all over.

Correct me if I'm wrong...
If the jury can't render a unanimous verdict, Google are
entitled to a mistrial. By the time it gets tried again,
the patents are probably going to be invalidated.
If a member of the jury was lying about something that would
have got them excluded in voir dire, then you also get a
mistrial (they may have been using knowledge that wasn't
presented in evidence to try to sway the other jurors).
So Google don't need to do any digging.
Since Oracle don't want a mistrial, it's not in their
interests to go digging either. But their interests would
have best been served by not shovelling this case, steaming
and buzzing with flies, into the courtroom in the first
place, so who knows what they'll do.
