Jury question - can "containing" mean inclusion of process
Authored by: Anonymous on Wednesday, May 16 2012 @ 03:49 PM EDT
Rachel King @ZDNetRachel

Jury: can "containing" mean inclusion of process, i.e. the symbolic
reference resolution? or is it strictly referring to literal contents?

[ Reply to This | Parent | # ]

Oracle - Yes, Google - No

Oracle says "containing" means inclusion of process. Google disagrees,
says confined to literal contents.

Judge takes Google's side - literal only
Authored by: Anonymous on Wednesday, May 16 2012 @ 03:51 PM EDT
Rachel King @ZDNetRachel

Judge says Google's view is best; "cant imagine any other way to go on
this;" said even Mitchell saw this. Going with literal contents only

Rachel King ‏@ZDNetRachel

Despite Jacobs trying one last time to convince him otherwise, Alsup said no to
ORCL. Jury coming back into courtroom for instructions.

Oracle says "containing" means inclusion of process. Google disagrees, says confined to literal contents.

Jury: Please tell us how to rule on the '104 patent.
Oracle: You should rule in our favor!
Google: Nooo, you should rule in OUR favor!

Can't wait to see what Judge Alsup tells them. My prediction is he says "your instructions are clear" and doesn't give them any more hint about this particular q.

Jury actually gearing up to leave at 1PM. Judge asked if that's still the case.
ALL of them nodded. They're ready to hit the road.

Oracle's lawyers were all here already, as was Google's Bruce
Baber, who has been on watch all AM. Alsup arrived before
rest of team Google

Note hasn't been read out - both sides in a huddle
Authored by: Anonymous on Thursday, May 17 2012 @ 03:37 PM EDT
Rachel King ‏@ZDNetRachel
Note hasn't been read yet, but both sides are deep in huddle
about what to do with the jury's question. What does it say??

"simulating execution of the bytecodes…" in patent '520.

Jury asking how to evaluate the evidence on how Android works
Authored by: Anonymous on Thursday, May 17 2012 @ 03:44 PM EDT
Rachel King @ZDNetRachel
Question isn't a legal question, not asking about meaning of
instructions; asking how to evaluate the evidence concerning
how Android works

Alsup offers to bring the jury back for 5 minutes each way arguments
Authored by: Anonymous on Thursday, May 17 2012 @ 03:47 PM EDT
Rachel King ‏@ZDNetRachel
Alsup offering to bring the jury back out so each side can
argue for 5 minutes each on how to answer the question.

Jacobs says no to argument - wants court to decide. Van Nest weighing options
Authored by: Anonymous on Thursday, May 17 2012 @ 03:48 PM EDT
Rachel King ‏@ZDNetRachel
Jacobs said no to the argument and says let court give
advice. Van Nest seems caught in the middle between that and
5-min argument option

Alsup : Jury must decide themselves
Authored by: Anonymous on Thursday, May 17 2012 @ 03:50 PM EDT
Rachel King @ZDNetRachel
Alsup's ruling: Your ? is one that goes to the weight of the
evidence, so that's up to you to decide. (basically, figure
it out yourselves)

Jury reaction
Authored by: Anonymous on Thursday, May 17 2012 @ 04:00 PM EDT
Rachel King @ZDNetRachel
When Alsup told the jury he couldnt help them, one juror
nodded, while another looked down, maybe upset. The others
didnt reveal any emotion

Want Mitchell transcript read...
Authored by: Anonymous on Thursday, May 17 2012 @ 04:51 PM EDT

Jury requesting transcript of a portion of Dr. Mitchell's testimony be read;
concerning pattern matching versus simulated execution.

Will take 30 minutes to prepare...
Authored by: Anonymous on Thursday, May 17 2012 @ 04:53 PM EDT
Rachel King ‏@ZDNetRachel

Jacobs said it will take 10 min to prepare. Van Nest said 25. Judge giving 30
minutes.

Rachel King @ZDNetRachel

Will be back in 30, but we can ponder until then about what the jury might be
thinking.

Yet another note!
Authored by: Anonymous on Thursday, May 17 2012 @ 05:15 PM EDT
Rachel King ‏@ZDNetRachel

First time I've ever seen a jury note handed to Alsup. He ordered for lawyers to
be called back, although originally it wasnt until 2:20

Rachel King ‏@ZDNetRachel

Google went straight into huddle mode. This is business. Alsup asking to get
Oracle lawyers up here now.

Rachel King ‏@ZDNetRachel

Huddle breaks. Alsup says he'll continue with another case in the meantime.

Missing court reporter...
Authored by: Anonymous on Thursday, May 17 2012 @ 05:19 PM EDT
Rachel King @ZDNetRachel

Oracle's lawyers are back, but the problem now is the regular court reporter for
#OraclevGoogle isn't in the room.

Rachel King ‏@ZDNetRachel

The current court reporter seems reluctant to take over in #OraclevGoogle.

Rachel King ‏@ZDNetRachel

Alsup doesn't care. Tells the court reporter to do it anyway.

A juror is sick - wants tomorrow off
Authored by: Anonymous on Thursday, May 17 2012 @ 05:23 PM EDT
Rachel King ‏@ZDNetRachel
Juror note: I'm sick. Can I get a sick day without being
discharged. Sorry.

Rachel King ‏@ZDNetRachel
She's coughing into her shirt now. Alsup mulling over what
to do. She says she doesnt want to be discharged -- very
animatedly.

Rachel King ‏@ZDNetRachel
Juror says she wants to take a nap because she's tired. (I'm
not making this up.)

Rachel King ‏@ZDNetRachel
Alsup says if you want to go home now, he's sympathetic. If
she wants Friday off, he's skeptical.

Plan is go home now - if sick tomorrow then dismissed from jury
Authored by: Anonymous on Thursday, May 17 2012 @ 05:26 PM EDT
Rachel King ‏@ZDNetRachel
Here's the plan: Send jury home now. If she's still sick
tomorrow, she gets discharged. Alsup not wasting time, but
jury dropping like flies

Rachel King ‏@ZDNetRachel
Entire jury back now. Alsup gives plan rundown; jokes she
hangs at hospital too much.

Transcript not available now - jury are heading home
Authored by: Anonymous on Thursday, May 17 2012 @ 05:29 PM EDT
Rachel King ‏@ZDNetRachel
So guess we're not getting that transcript reading today.
Jury will be heading home now instead of 4PM.
