against them on their various insane overreachings, with a virtually
appeal-proof trial record that leaves no excuse for the appeals court to throw
out the findings and order a retrial.
Appeal-proofing his ruling is actually a good example of judicial efficiency, I
would argue. It's been obvious from the start of the trial (and the absolute
unwillingness of the parties [i.e., Oracle] to reach a settlement) that the
loser would pursue every appeal, so covering all possible angles, even the silly
ones, and making all possible use of the jury's valuable time on the first
go-round would seem eminently sensible from the judge's perspective.
