Alsup: No way Oracle can get hyper-extreme damages
Authored by: Anonymous on Monday, May 14 2012 @ 11:30 AM EDT

Judge says again there's no way ORCL can get hundreds of
m/billions of $ for rangeCheck. No law allows such a "hyper-
extreme proposition"

Phase 3 to include rangecheck etc & patents, not SSO
Authored by: Anonymous on Monday, May 14 2012 @ 11:31 AM EDT
Rachel King ‏ @ZDNetRachel
Alsup: If liability is established for any of the patents,
then we're going to have phase three (damages) on patents.

Rachel King ‏ @ZDNetRachel
In any event we're having phase 3 on decompiled rangeCheck.
Not going to have phase 3 on copyrights yet b/c that hasn't
been established yet

Case to consider only up to complaint date
Authored by: Anonymous on Monday, May 14 2012 @ 11:32 AM EDT
Rachel King ‏ @ZDNetRachel
Alsup: The ruling is going to be we measure things up to the
date of the filing of the complaint. I hope that solves some
of our problems.

Alsup: rangeCheck & decompile not worth hundreds of millions
Authored by: Anonymous on Monday, May 14 2012 @ 11:34 AM EDT
Ginny LaRoe ‏ @GinnyLaRoe
Alsup: There is no way that the law should allow a
disgorgement theory in the billions or hundreds of milions
over Rangecheck or decompile.

August: No symbolic references of any kind = No infringement
Authored by: Anonymous on Monday, May 14 2012 @ 11:39 AM EDT
Caleb Garling ‏ @CalebGarling
Dr August (Google's expert) rebuking Dr Mitchell (Oracle's).
Mitchell is sitting attentively, listening, but betraying no
emotion

Ginny LaRoe ‏ @GinnyLaRoe
Google expert: "Android doesn't contain symbolic references
of any kind ... so there's no infringement."

30-45 minutes more cross exam then rebuttal. August grimaces
Authored by: Anonymous on Monday, May 14 2012 @ 12:19 PM EDT
Rachel King ‏ @ZDNetRachel
Alsup asked Jacobs how much longer cross-examination of
August will be. 30-45 min, followed by rebuttal. I swear
August grimaced at that.

Something top secret we are not allowed to know about
Authored by: Anonymous on Monday, May 14 2012 @ 12:44 PM EDT
Rachel King ‏ @ZDNetRachel
Jacobs wants a sidebar. Alsup asks if it's something the
witness or the public can't hear. Van Nest said it was the
latter.
