Oracle v. Google

I meant to add, saying that no reasonable jury could come up with
the decision that they did just strikes me as totally
irresponsible. In effect, he is saying the jury is not reasonable,
so he might as well declare a mis-trial right now.

Judge Alsup has seemed pretty good on the whole, although I do at
times feel this whole case is a bit of an ego-trip for him. As I
see it, Oracle's claims are pretty pathetic and should not be
wasting the court's time.

You only appeal when you lose

If Google wins then they will not appeal. So far the judge has strongly hinted that Oracle is not going to be happy with the damages from the copyright claims so it is likely only Oracle will want to appeal. By deciding in favor of Oracle on this particular point it should have given Oracle one less cause for appeal. Of course, the lawyers have neatly turned that logic on its head and are now trying to convert a win on this point into new grounds for an appeal.

We saw tricks like this in the sad SCO saga. Eventually one learns to never give BS&F an inch because if you do they will try to take a light-year. IMO this kind of gaming corrodes the judicial system and if the gaming is not stopped, it will eventually destroy the system to the detriment of us all.
