$150,000 is probably about 1% of Oracle's costs for this entire trial. It
is laughably small. However, if they could get, say, 1% of Google's Android
profits, that would make the entire trial worthwhile from a purely pecuniary
perspective.
At this late stage of the game, accepting a $150,000 cap on
the copyright damages would be pretty much a total loss for Oracle. Almost
anything would be better than that. With their new hare-brained tactic they
give the judge plenty of opportunity to make a mistake that will get them a
chance to appeal and perhaps win a do-over. ISTM that even a tiny sliver of
hope of success is far better than certain defeat.
Sure, it is a little bit
like Jack selling the family cow for three magic beans but in this case they
knew the cow was pretty much worthless while there is still some hope something
good may come from the magic beans.
