Jacobs attempting to get HTC Incredible handset into case.
Authored by: Anonymous on Friday, May 11 2012 @ 10:47 AM EDT
Rachel King ‏ @ZDNetRachel
Jacobs now arguing with Van Nest, saying we should be able to
talk about the HTC Droid Incredible 2. They're "lost in the
terminology"

Rachel King seems to think we won't see Schwartz, Catz, Eustace or Wong
Authored by: Anonymous on Friday, May 11 2012 @ 10:51 AM EDT
Rachel King ‏ @ZDNetRachel
If we're only hearing from those ppl Van Nest mentioned, that
means Google cut Alan Eustace, Safra Catz, Hinkmond Wong, &
Jonathan Schwartz

Not sure if she's right or if it's just the initial list that
excludes them.

It would be a shame not to hear from some of them...

More source code to come...
Authored by: Anonymous on Friday, May 11 2012 @ 10:52 AM EDT
Rachel King ‏ @ZDNetRachel
Google atty promises "more source code this morning" to the
jury with a grin. I'm pretty sure no one here wants more
source code.

Everyone's fed up with all the detailed stuff

Caleb Garling ‏ @CalebGarling
Andy McFadden: How deeply should I answer that? Google: ...as
not deeply as possible. Everyone: laughter. (Tech details
have gotten dense)

Oh no... courtroom "humour"
Authored by: Anonymous on Friday, May 11 2012 @ 11:37 AM EDT
Rachel King @ZDNetRachel
Thx to who ever decided to include "fun" on this virtual
machine. Makes for interesting convo. Jacobs to McFadden:
Some of us are having fun

Georges Saab @gsaab
Court humor: example uses 'fun' as a variable name. Leading
lawyer to say things like "So we are now having fun with
fun?" #OraclevGoogle

Everyone's still bored with the tech details
Authored by: Anonymous on Friday, May 11 2012 @ 11:48 AM EDT
Rachel King ‏ @ZDNetRachel
Jacobs to redirect McFadden again. Alsup: "There's more?
::sighs:: Go ahead." (We're all with you on that one, judge.)

Oracle's Gupta says that Sun patents were NOT discussed re. android
Authored by: Anonymous on Friday, May 11 2012 @ 12:07 PM EDT
Rachel King ‏ @ZDNetRachel
Gupta defends that Sun-Google didn't discuss patents, and any
references to patents referred to other things at Sun &
Google.

New witness hass been in court almost everyday?
Authored by: Anonymous on Friday, May 11 2012 @ 12:10 PM EDT
Rachel King ‏ @ZDNetRachel
Now on the stand: Terence Parr, expert witness for Google. CS prof at USF. He's also been here at court almost everyday
I thought that poential witnesses were supposed to be told by the attorneys not to attend court prior to their testimony? I distinctly remember those orders from the judge in the SCO v. Novell trial. Was that a special case, or was it the norm?

Willfulness being discussed
Authored by: Anonymous on Friday, May 11 2012 @ 12:36 PM EDT
Rachel King ‏ @ZDNetRachel
Van Nest & Jacobs agreed copyright willfulness & patent
willfulness will be tried in phase 2.

Rachel King ‏ @ZDNetRachel
Jacobs: We're talking about willfulness to extent that
infringement has been found so far in the case.

Seems like the willfulness boat was possibly sunk by Gupta if
the jury believe him.

Boies confirms that they are going after infringer's profits - Alsup: "O Rly?"
Authored by: Anonymous on Friday, May 11 2012 @ 12:41 PM EDT
Rachel King ‏ @ZDNetRachel
Boies: Oracle is going after "infringed profits" case -- not
statutory damages. Alsup doesn't think that will help their
case.

Parr is the only witness thus far who actually appears to be
having a fun time on the witness stand.

bordering on arguing, but hushed. Hearing "legal issue" and
"revenue"

latest sounds like oracle are trying to negotiate
Authored by: Anonymous on Friday, May 11 2012 @ 02:46 PM EDT
Maybe some kind of settlement instead of phase 3...

Rachel:
Went to the hallway, came back, and there's a joint
Oracle/Google huddle. Crap, I'm missing all the action!
Sounds like they're talking $$$

Caleb: "Made out: "How much is this worth to you?" but
couldn't hear answer (or I did and not tipping off the
other press #headfake)
