Except that while, admittedly for very good reason, we all care most about this
API copyright nonsense, the Schwartz testimony and related arguments go to
estoppel, which if I understand correctly cuts against both copyright and patent
claims. I could hardly see Google dropping that now, particularly after the jury
decided 4A in their favor for copyright already.
