But its not quite that simple. That Google didn't nail Mr. McNealy to the floor was their bad, not Oracle's. So no new trial on that score.

But we have seen myriad ways Google could better argue the copyright phase, which is why they insist on anonymous verdict: a hung jury means a new trial -- possibly (IANAL) on all copyright issues -- unless Judge Alsup rules in their favour anyway.

But you are right in that PJ's little dumpster dive is almost certainly one of the reasons Google wants Mr. Schwartz back during the patent phase.

and this is why i post anonymously

there was a leak to pirates about DRM work that was found
gleaned off a UK laptop that both SUN and oracle as well as a
ferw others worked on ....this was a long time before sun was
sold to oracle and if you looked at the 7gb of data you'd see
how intermingled both companies were ....its hard to see why
oracle would go this route knowing of the that guy....
