Audience
Splitting hairs once again, Oracle’s lead counsel
Michael Jacobs quibbled briefly with Google attorneys Robert Van Nest and Bruce
Baber.
Jacobs suggested that the general audience should refer to an
observer who is knowledgeable about the subject area. Van Nest and Baber argued
that it should refer to basically anyone.
Judge William Alsup gave this one
to Jacobs, saying he would instruct the jury to infer that the “average audience
means those who would be expected to read the copyrighted works.” In this case,
that would mean anyone who can read the Java programming
language.
Gee, once again the "Honorable" Judge Alsup gives
another one to Oracle.
What does "General Audience" mean to you? To me it
would mean "basically anyone".
It looks to me like the "Honorable" Judge
Alsup is pushing the jury in the direction of finding for Oracle.
I guess
this will go on for years on appeal. And the FUD continues against open source.

Even if they end up with an answer which is "wrong" ;) at least they
seem to be
hearing it all out and not rushing to a verdict without thinking it through.
Good on 'em I say - I'd do the same.

This has to warm your heart. Any thoughts on how much weight it can add to his
decision? How does the law work re: adding new info at this point?
BTW is the
judge following the reporting? He reamed a reporter this morning for some thing
said in a tweet.
