Thank you for the summary of the difference between law and equity in the US -
it's always a useful distinction to be aware of - and will be until equity and
the law merge (which I think they will, eventually).
Just in case people are still wondering why the bankruptcy court in the SCO
business seemed to play a bit fast and loose with the law, it's partly because
US bankruptcy courts are courts of equity and not courts of law (AFAIK) - I'm

PJ & Mark have provided a forum that yields not just
balanced facts, but edifying discussion.
I am now reading the pdf of Google's proposed findings of
fact and conclusions of law.
Therein are described several equitable defenses for
Judge Alsup's ( not the jury's ) consideration.
