I seem to recall an episode where Tony goes to all the prominent divorce
attorneys and retains them for consultation, so his wife can't use any of them.
It
seems like the U.S. government has asserted a similar strategy, except it
already
had every law firm on retainer for something or other to start with.

It's an expectation thing

I expect a certain portion of the US Authorities to behave that way - because it seems there is a section willing to abuse their authority. So I'm not surprised when I read about that although I still stand for the proposition such behavior is wrong.

I expect BSF to behave that way - because they have an incredibly time proven track record on such behavior. So I'm not surprised when I read about such behavior - again, still standing for the proposition it's wrong.

I didn't expect such a statement to come from a MoFo Lawyer as they don't - in my experiences - have such a track record. As a result, I was surprised when Jacobs put forth such an argument - and of course, it's still wrong!

It's like having a constant good kid and a constant bad kid. When the bad kid does something bad - no surprise. If the good kid ends up doing something bad, behavior that is very out-of-character, then it becomes a surprise. In both cases bad behavior is still wrong. But the sudden change from expectation leads to surprise.

Of course, the concept outlined above should be pretty obvious and plain to most adults so I shouldn't really have had to explain it in such detail.
