Jurisdiction of the EU Court of Justice

As I understand it (and I am neither a European or an expert) the ECJ is not in
the appeal path (although it might be after the UK Supreme Court has ruled? - of
that I am not certain). However, the ECJ is expert in interpreting Council
Directives, which is what the High Court judge has asked it to do.

You can think of it this way: since Council Directives are not, strictly
speaking, UK law, but are (more or less) enforceable in the UK, the judge has
invited an expert to prepare a report for him on the correct interpretation of
those Directives. It's important that the Directives are applied consistently
across the EU, as that's how they are intended to be applied.
