The IBM case has been reopened, scheduled, then bounced from judge to judge, and
now is not scheduled. I wonder if the lack of scheduling is Utah's way of
telling the Delaware bankruptcy court, "No, we're not going to try this
turkey. Declare Chapter 7 like you should have done two years ago."
And the Delaware court is saying, "No, we're not going to declare Chapter
7, because the IBM suit is the only chance for the creditors to get paid. So
schedule the case for trial."
Is this reading of events at all realistic? And if it is, who's going to blink
first?
Isn't there some limit on when the Delaware BK court is going to have to stop
this mess?
