If I were Oracle I would have argued that it was an official release but that
the expectation was that it would be Java/Linux and that there was an
expectation that Google or the handset manufacturers would take licenses from
Sun for the Java part.
I don't see anything at the time indicating that Google had made clear to Sun
that they wouldn't be taking a license (or even if it was clear which parts of
the Android libraries were the same and which were different) as I thought the
SDK was not released until a week later at which point Sun became rather silent
on the topic of Android.
I think arguing that it was not official was silly but I also think it is pretty
far from any form of copyright license.
If there is no copyright protection for the material used by Google this doesn't
matter but if there is protection I think it would be ridiculous to consider
