Transformation as the Joker?
Authored by: Christian on Tuesday, May 01 2012 @ 01:21 PM EDT
But what amount of transformation is required to satisfy fair use?

Converting a novel to a movie is a transformation, but it is not fair use.

There is a reasonable perspective from which the Dalvik system is primarily a
Java replacement meant to avoid licensing, and there is another reasonable
perspective from which it is a completely different system with different
mechanics and a different purpose. Without legal guidance on interpreting
"transformation" in fair use doctrine, it is hard to know which is
more consistent with the law as understood from previous cases.
