Not completely. B&N refused to sign an NDA, so to the
extent that MS actually threatened them with specific
patents, we know which ones (and that they are very weak).

And every remaining potential victim knows that if you push
back hard enough, Microsoft will cough up $300M to save
face.

That's practically a viable business model - reverse patent
trolling:
1. Publicly use Linux
2. Wait for MS to attack you with their weak patents
3. Call them out for anti-trust and try to get their patents
re-examined
4. Profit.

Unlike the business plans of the Axis Of Trolling
(MS/Oracle/SCO) steps 1 and 2 are ethical, step 3 is known
and step 4 is possible.

I thought they were finally going to be called out, but sadly another NDA
(probably) prevents us from getting the details, and ensures they are free to
act like this again (or possibly that they now can't prove their innocence ;)

New laws needed?

Maybe if you sue someone over patents, you shouldn't be able to sue them
again with other patents unless they are newly registered since the original
case.

This would force patent trolls (obviously don't mean MS..) to use all their
ammunition at once rather than negotiate on one set then threaten to sue on
another unspecified set.

I agree that the MS patents won't be tested in court, but 17.5% will hardly give
MS effective control of the Nook company (to force it to disappear). You could
say that MS has been obliged to pay $300Million to extract themselves from the
litigation.

Whatever's happened behind closed doors, MS is now seen to be investing in
Android (and Linux), which gives Android the MS "seal of approval".
Certainly it seems to contradict all the years of "Get the facts"
FUD.
