No.
An audio CD of 4'33" will contain a ToC and tracking info.
It will contain at least one Red Book formatted audio track,
in which most of the samples will be close to zero value.
It is not possible to record absolute zero sound with current
equipment. Also the player is permitted to tap her fingers
on the piano to signify the end of the performance.

I have recorded a public performance, and released a CD
in limited private circulation. Including audience applause
is at producer's discretion.

There is a difference between a tape recording that is exactly four minutes
and thirty three seconds long, and tape that is unused/blank. The former is
a copyvio, the latter is not.
