The API isn't the "blueprint" for that house, as such blueprints would contain materials used and such. The API is the "walking tour" information. It's the "on the left you will find the master bedroom" and "off the kitchen is a porch" information. The houses themselves have different materials and dimensions and may differ in all sorts of detail.

I would go as far to say that the API Definition (and lets be clear that that is what Oracle is claiming is both covered by copyright and infringed by Google) is actually just a list of requirements that a particular house must meet.

For example:
  • North-facing
  • Three bedrooms
  • Two Bathrooms
  • Open plan living area
  • Large kitchen

Now any number of architects could design a house to meet this specification but none of them could law claim to a copyright on the specification. They can, however, lay claim to their implementation (i.e. the plans they created and drafted).

Technically, Apache was trying to make Java APIs. Their goal, stated openly from the beginning, was to make an Apache-licensed implementation of Java, legally called Java. Of course, they weren't going to be allowed to call it Java until they got all the details right and managed to pass the certification tests. But the plan was to make real Java, and that plan looked fine until Sun reneged on their promise to make a non-restrictive version of the certification test.

Anyway, the APIs of both Java and Harmony are basically identical, except in those cases where the Harmony API was considered incomplete. And a difference that makes no difference is no difference.
