The concept of clean room goes back to IBM and the original
BIOS for the (at the time) new PC. IBM had a copyright on the
BIOS code (firmware) and did not want anyone else to duplicate
the functionality, opening the way for clone PC hardware.
It was legally decided back then, that a clean room
implementation that matched the specifications (the API of the
BIOS), was not infringing on IBM's copyright.[ Reply to This | Parent | # ]

It's Oracle's smokescreen of this that is in danger of flummoxing
the jury. To us here an API License, or an API Specification License,
is a mythical beast. What powers would it confer on the holder
that he did not already have under natural and common law?
