When has such a technicality been a burden to BSF in the past?

From the link Steve provided above:

They're claiming Android violates copyrights, but Davlik
does not.

You tend to only get one bite at the apple, legally
speaking. If you could have brought a related action (like
a copyright claim against Davlik) the first time, and
didn't, there's a pretty high hill to climb to bring it
later.

I've just written some applications

for Android in C++ and QT using Necessitas.
Would they become liable if Oracle won?
