The APIs are already GPLed

Isn't that due to a Linux-specific exemption, though? Though perhaps that won't
be needed any more if we get a good ruling here.

Anyhow, APIs seem very strongly analogous to to the copied menus in that one
case (Borland?), so I hope they're ruled to be non-copyrightable. Making exact
copies is required for compatibility. Maybe if you copied copyrighted
documentation they could have a case, but in terms of the API itself, if you
make anything but an exact mirror, people will not be able to run any code using
the APIs without changing it, destroying compatibility.

And the Harmoney Implementation is Apache'd.
