I don't see anything about outlawing software patents.

It could be just the opposite - "How do we streamline things to avoid all
this messy PR that results in people calling us bad names like 'troll'?"

From a lawyer is a very different thing to outlawing.

I have had many a (alcohol fueled or otherwise) debate with IP lawyers about
(IM[NS]HO) how ridiculous is the idea of software patents.

The only thing hat has come of it is that they and I will never agree, and they
don't 'get' software, and I don't 'get' the law.

While I appreciate the sentiment while lawyers are 'sorting out the problem'
they don't need a bunch of geeks shouting at them about the fact the problem
shouldn't exist in the first place, there does need to be some kind of mediated
forum where the two positions can be bought to common ground,and that requires
both views to be heard equally and both sides to accept accept some validity in
the others positions.

Nope. They are there to try to figure out how
to make software patents work without endless
patent wars that are costing them big bucks.
They do want to keep their patents, however.

THey are excluding the discussion about whether
software patents should even be patentable,
because they want to try to keep them.
