The purpose of my post was to highlight Oracle's inconsistency, possibly in a
way that would be useful to Google in the current court case. Just exclaiming
that it is obvious Oracle's wrong, while truthful, is not helpful.
If the
entire JSPA process was based on the assumption that APIs are free for everyone
to use and not protected by copyright then that might go a long way in
convincing the judge and jury that Oracle is being inconsistent regarding the
copyrightability of the Java APIs. Perhaps Google could ask them when they
changed the minds and what notice they gave to people who had already
re-implemented the APIs and were distributing them freely.
