It's a point of focus because creative expression is what copyright is designed
to protect. Not expression which involves a lot of effort, but creative
expression.

Copyright isn't there to reward hard work: I can't copyright an English bond
brick wall just because it took many days to lay. Similarly patents aren't
there to reward hard work, they exist to promulgate information about tangible
innovation.

Creativity is at the heart of the intellectual 'property' that copyright and
patents are meant to protect. I don't think the distinction between mere effort
and creativity gets made often *enough*.
